Acceptable Use Policy

1. Introduction

This Acceptable Use Policy ("AUP") forms an integral part of the Terms of Service (the "Agreement") governing the use of UtaProxy's products, services, and related systems (collectively, the "Services").

By accessing or using the Services, you acknowledge that you have read, understood, and agreed to be bound by this AUP.

The purpose of this AUP is to establish clear standards of acceptable conduct, prevent misuse of the Services, and protect the security, integrity, and availability of our infrastructure and that of third parties.

2. Prohibited Activities

Users may not use, encourage, facilitate, or permit others to use the Services for any activity that is unlawful, harmful, abusive, fraudulent, or otherwise inconsistent with this AUP.

The following activities are prohibited, including but not limited to:

2.1 Illegal or Unlawful Conduct

  1. Any activity that violates applicable local, national, or international laws or regulations.
  2. Fraudulent activities, including identity theft, impersonation, misrepresentation, or unauthorized account access.
  3. Money laundering, terrorist financing, or other illicit financial activities.
  4. Unauthorized access to restricted government systems, public infrastructure, or protected data sources.

2.2 Harmful, Abusive, or Malicious Conduct

  1. Transmitting or distributing malware, viruses, ransomware, spyware, or other harmful code.
  2. Conducting or participating in DDoS attacks, port scanning, system probing, or security testing without explicit authorization from the relevant system owner.
  3. Engaging in spam, bulk unsolicited messaging, or other disruptive mass-automation activities.
  4. Interfering with, degrading, or attempting to circumvent security measures, authentication mechanisms, or access controls of any system, platform, or network without authorization.
  5. Using the Services to intentionally disrupt, damage, or impair the operation or availability of any system, service, or network.

2.3 Platform Abuse and Unauthorized Data Activities

  1. Scraping, harvesting, or collecting data in violation of applicable laws, contractual restrictions, or the applicable terms or policies of the target platform.
  2. Circumventing or defeating CAPTCHA systems, rate limits, authentication mechanisms, or other security or access controls without authorization.
  3. Accessing, collecting, processing, or distributing personal data without an appropriate lawful basis, authorization, or other legally permitted grounds.
  4. Using the Services to create, distribute, or operate automated systems for deceptive, fraudulent, or manipulative purposes.

Users are solely responsible for ensuring that their use of the Services complies with the applicable laws, regulations, contractual obligations, and terms of service governing the websites, platforms, networks, or other destinations they access through the Services.

2.4 Restricted or High-Risk Use Cases

The following activities are considered restricted or high-risk and may only be permitted with our prior written authorization:

  1. Online gambling, betting, or lottery-related activities.
  2. Adult content services or associated traffic-generation activities.
  3. Large-scale automation intended to artificially manipulate social media metrics, engagement, rankings, or visibility.
  4. Lead generation, contact scraping, or large-scale acquisition of personal or contact information.
  5. Other activities that we reasonably determine may present significant legal, security, operational, or reputational risks.

3. Fair Use Policy

For plans marketed as "Unlimited," no predefined data quota applies within the applicable session, subscription, or billing period. However, "Unlimited" does not mean unrestricted use without operational limitations, and all usage remains subject to this Fair Use Policy.

Users must ensure that:

  1. Traffic patterns remain within reasonable and non-disruptive operational thresholds.
  2. Automated processes do not impose excessive or abnormal loads on networks, endpoints, or integrated platforms.
  3. Service consumption does not materially degrade or threaten the stability, performance, or availability of the Services.
  4. Usage does not materially interfere with other customers' access to or use of the Services.

We may monitor and review usage patterns and, where reasonably necessary, apply technical or operational limitations, including throttling or temporary restrictions, to protect the stability, security, and availability of the Services.

4. Security, Compliance, and User Responsibilities

Users are responsible for:

  1. Maintaining the confidentiality and security of account credentials, API keys, authentication materials, and other access credentials.
  2. Using the Services in accordance with applicable laws, regulations, contractual obligations, and industry standards.
  3. Taking reasonable measures to prevent unauthorized access to or use of their account.
  4. Refraining from exposing internal endpoints, tokens, API keys, or system access credentials to unauthorized parties.
  5. Ensuring that activities conducted through the Services comply with the applicable requirements and policies of the target websites, platforms, networks, and services.

We may investigate suspected violations of this AUP and may request additional information or documentation from users as reasonably necessary to conduct a compliance or security review.

5. Reporting Violations

Suspected violations of this AUP may be reported to our support team.

Reports should include relevant facts, timestamps, account or service information where available, and supporting materials that may assist our investigation.

We will review reported violations and take appropriate action based on the circumstances.

6. Enforcement and Remedies

Where we reasonably believe that a user has violated this AUP, applicable law, or the Agreement, or that the user's activity presents a security, legal, operational, or other material risk, we reserve the right, where reasonably necessary and without prior notice, to:

  1. Limit, throttle, suspend, or restrict access to the Services;
  2. Suspend or terminate affected accounts;
  3. Block specific traffic patterns, destinations, endpoints, or usage types;
  4. Require additional information or verification;
  5. Cooperate with applicable law enforcement or regulatory authorities where legally required or permitted; and
  6. Take any other action reasonably necessary to protect the security, integrity, and availability of the Services and our infrastructure.

Severe, repeated, fraudulent, or intentional violations may result in permanent termination of access.

7. Amendments

We may modify or update this AUP from time to time.

Any changes will become effective upon publication on our website, unless otherwise stated. Continued use of the Services after the effective date of the revised AUP constitutes acceptance of the updated AUP.
